Terms of Use

These terms govern your use of the WakeOps iOS app and of nosnooz.net. By downloading or using the app you agree to them.

Please read section 3 carefully. It concerns the limits of what any alarm app on iOS can promise.

1. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use WakeOps on Apple devices that you own or control, in accordance with the App Store Terms of Service. You may not sell, rent, sublicense, redistribute or commercially exploit the app.

Except where local law expressly permits it, you may not reverse engineer, decompile or disassemble the app, attempt to extract its source code, or remove or alter any proprietary notices.

2. What WakeOps is for

WakeOps is a wake-up alarm app. Alarms can require you to complete a mission — such as holding a button, solving arithmetic, photographing a place you chose in advance, taking steps, or performing an exercise — before the alarm is resolved. It is a consumer convenience product. It is not a medical device, a safety system, or a sleep-diagnosis tool, and nothing it shows you is medical advice.

3. Alarm reliability — please read

Do not rely on WakeOps as your only means of waking up for anything important or safety-critical. We have built the app to be as dependable as iOS allows, but an alarm on a smartphone can fail for reasons entirely outside the app's control, including:

  • the device being switched off, restarted, or out of battery;
  • the device being in silent mode, with volume lowered, or with headphones or a Bluetooth speaker connected;
  • Focus, Do Not Disturb, Sleep mode, Low Power Mode or Screen Time settings suppressing or delaying alerts;
  • iOS withholding, delaying or discarding scheduled notifications, or the operating system terminating the app;
  • notification permission being revoked, the app being offloaded or deleted, or a change in system settings after an alarm was set;
  • software defects, operating-system updates, device faults, or the device being left somewhere you cannot hear it.

For any wake-up where the consequence of oversleeping matters — a flight, an exam, a shift, medication — use an independent backup alarm as well. To the fullest extent permitted by law, we accept no liability for a missed wake-up or for any consequence of one.

4. Missions and your safety

You are responsible for completing missions safely and for judging whether a mission is appropriate for you.

  • Physical missions (steps, push-ups, squats and similar) involve bodily exertion shortly after waking. If you have any injury, medical condition, or doubt about your fitness to exercise, consult a qualified professional before enabling them, and stop immediately if you feel unwell.
  • Photo missions require moving to a place and using the camera. Do not attempt a mission while driving, operating machinery, or in any situation where the distraction or movement would be unsafe.
  • Choose mission locations that are safe to reach in the dark and while half awake.

You use missions at your own risk, and you are responsible for your surroundings while doing so.

5. Subscriptions and payment

Some features require a paid subscription. Where an auto-renewing subscription is offered:

  • Payment is charged to your Apple ID account at confirmation of purchase.
  • The subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before that period ends.
  • You can manage and cancel your subscription in your Apple ID account settings on your device. Deleting the app does not cancel a subscription.
  • Where a free trial is offered, any unused portion of it is forfeited when you purchase a subscription.
  • Prices may vary by region and may change; a price change affecting an existing subscription takes effect only as permitted by Apple and by applicable law.

All billing and refunds are handled by Apple, not by us. Refund requests go through Apple's support channels and are subject to Apple's policies.

6. Your content

Anything you create in the app — alarms, labels, reference photos, history — stays on your device. You keep all rights to it. We do not receive, store or claim any licence over it. See the Privacy Policy for detail.

7. Intellectual property

WakeOps, its name, design, artwork, sounds, copy and software are owned by us or our licensors and are protected by intellectual property law. These terms grant you a licence to use the app, not any ownership of it.

8. Availability and changes

We may update, change or discontinue the app or any of its features, and may require you to install updates in order to keep using it. We may revise these terms; the “last updated” date above will change when we do, and continuing to use the app after a revision means you accept it.

9. Disclaimer of warranties

To the fullest extent permitted by law, WakeOps is provided “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any alarm will fire at the intended moment.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing in these terms limits any consumer right you have that cannot lawfully be limited.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, opportunity, earnings or data, arising out of your use of or inability to use WakeOps — including a missed or delayed alarm. Our total liability for any claim relating to the app is limited to the amount you paid for it in the twelve months before the claim arose.

11. Termination

You may stop using WakeOps at any time by deleting it. This licence ends automatically if you breach these terms. Sections 6 to 10 survive termination.

12. Apple

WakeOps is distributed through the App Store. Apple is not a party to these terms and has no responsibility for the app or its content. Apple has no obligation to provide maintenance or support for the app, and any claim that the app fails to conform to an applicable warranty may be directed to Apple for a refund of the purchase price. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Your use of the app must also comply with the App Store Terms of Service.
